1. Acceptance of Terms

By accessing or using the Elite Custom Curb website (elitecustomcurb.com) or engaging our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

2. Services Provided

Elite Custom Curb provides decorative concrete landscape curbing installation, stamped concrete curbing, and curbing repair services in the Quad Cities area of Illinois and Iowa. All services are performed by trained professionals and are subject to availability.

Service descriptions on our website are provided for informational purposes. Actual project scope, materials, and pricing will be determined during an on-site estimate and confirmed in a written service agreement before work begins.

3. Estimates & Pricing

We provide free on-site estimates for all curbing projects. Estimates are based on measurements taken at the time of the site visit and are valid for 30 days unless otherwise stated.

Final pricing is based on actual linear footage, selected curbing profile and finish, site preparation requirements, and any additional work agreed upon. Pricing may change if the scope of work changes after the initial estimate.

4. Service Agreement

Before work begins, you will be provided a written service agreement detailing the scope of work, materials, pricing, and estimated timeline. Work will not commence until this agreement is signed by both parties.

Any changes to the agreed scope of work must be discussed and approved in writing. Change orders may result in adjusted pricing and timeline.

5. Payment Terms

Payment terms will be outlined in your service agreement. Generally, payment is due upon completion of the project and your final walk-through approval.

We accept cash, check, and major credit/debit cards. Returned checks or declined payments may be subject to additional fees.

For larger projects, a deposit may be required before work begins. The deposit amount will be specified in the service agreement and applied toward the final balance.

6. Scheduling & Cancellations

Project dates are scheduled based on mutual agreement and are subject to weather conditions. Concrete curbing cannot be installed during rain, extreme cold, or other adverse weather conditions. We will work with you to reschedule if weather causes a delay.

If you need to cancel or reschedule your project, please contact us at least 48 hours before the scheduled installation date. Cancellations made less than 48 hours in advance may forfeit any deposit paid.

Elite Custom Curb reserves the right to reschedule work due to weather, equipment issues, or other factors beyond our control.

7. Warranty

Elite Custom Curb stands behind the quality of our work. We provide a warranty on our curbing installations covering defects in workmanship and materials. The specific warranty duration and terms will be outlined in your service agreement.

The warranty does not cover:

• Damage caused by improper use, abuse, or neglect

• Damage from vehicles, heavy equipment, or excessive impact

• Normal wear and tear, including minor hairline cracking (which is common in concrete and does not affect structural integrity)

• Damage caused by tree roots, soil erosion, or improper drainage

• Alterations or repairs performed by anyone other than Elite Custom Curb

• Damage from acts of nature (flooding, earthquakes, severe storms)

To make a warranty claim, contact us with your project details and a description of the issue. We will schedule an inspection and determine if the issue is covered under warranty.

8. Liability Limitations

Elite Custom Curb will exercise reasonable care and professionalism in performing all services. However, our total liability for any claim arising from our services shall not exceed the total amount paid for the specific project in question.

We are not liable for:

• Pre-existing conditions of your property, landscaping, or irrigation systems

• Damage to underground utilities, pipes, or sprinkler lines not disclosed or marked prior to installation

• Variations in concrete color due to weather conditions, curing processes, or batch differences (these are natural characteristics of concrete)

• Minor surface cracking, which is a normal characteristic of poured concrete

• Delays caused by weather or circumstances beyond our control

It is the customer’s responsibility to mark or disclose the location of any underground utilities, irrigation lines, or other subsurface features before work begins.

9. Property Access & Preparation

You agree to provide clear access to the work area on the scheduled installation date. This includes removing obstacles, vehicles, pets, and personal property from the work zone.

Newly installed curbing requires a curing period. You agree to keep foot traffic, vehicles, lawn mowers, and sprinklers away from the curbing for the duration specified by our crew (typically 24–48 hours).

10. Intellectual Property

All content on the Elite Custom Curb website, including text, images, logos, and design, is the property of Elite Custom Curb and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use our content without written permission.

11. Website Use

Our website is provided for informational purposes. While we strive to keep information accurate and up to date, we do not warrant that all content is complete or error-free.

You agree not to use our website for any unlawful purpose, attempt to interfere with the website’s functionality, or transmit harmful code or data.

12. Dispute Resolution

In the event of a dispute arising from our services, both parties agree to first attempt to resolve the matter through good-faith direct communication. If a resolution cannot be reached, the dispute shall be resolved through mediation or, if necessary, binding arbitration in accordance with the laws of the State of Illinois.

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions.

14. Changes to These Terms

We reserve the right to update or modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our website or services after any changes constitutes acceptance of the updated terms.
